1. Agreement to Terms
By using or placing an order through our website (the “Site”), you (“you”, “Customer”) agree to be bound by these Terms of Service (“Terms”) and by our Privacy Policy, Refund Policy and any other policies posted on the Site. If you do not agree to these Terms, please do not access or use the Site.

2. Who We Are
“SRS”, “we”, “us”, “our” refers to Safe Road Services, a Massachusetts-based bulk salt and de-icing materials supplier. We provide materials, products and services as described on the Site.

3. Orders and Acceptance
3.1 All orders placed via the Site are subject to our acceptance. We reserve the right to refuse or cancel any order for any reason.
3.2 Once we accept your order, a contract is formed under these Terms.
3.3 We may update or change product offerings, pricing, specifications, or availability without prior notice.

4. Payment, Pricing & Taxes
4.1 You agree to pay all amounts shown in your order (including applicable taxes, shipping or delivery fees) when you place the order.
4.2 Prices are as shown on the Site at the time you place your order, unless a typographical or other error is evident.
4.3 You are responsible for any taxes applicable to your purchase (we will charge any required sales tax or other tax as required by law).
4.4 Payment methods accepted are those displayed on the Site; you represent that you are authorized to use the payment method you choose.

5. Shipping, Delivery & Bulk Orders
5.1 Delivery terms will be as set out on the Site or in your order confirmation.
5.2 For bulk or contract orders, you acknowledge that delivery schedules can vary and you are responsible for coordinating acceptance of delivery.
5.3 For bulk orders specifically: “All sales are final. No refunds or cancellations are permitted. If Buyer does not take full delivery during the season, Seller may, at its discretion, store remaining salt subject to storage fees or offer a credit toward a future season.”

6. Returns, Refunds & Cancellations
6.1 Except as otherwise set out (for example in the Bulk Orders section), all sales are final once accepted.
6.2 In cases of damaged or defective goods, you must notify us within 1 day of delivery and provide photo documentation for review. We may, at our discretion, replace the goods or issue a credit.
6.3 Custom or special-order items are non-cancellable, non-returnable and non-refundable.

7. Intellectual Property
All content on the Site (text, graphics, logos, product images, software, etc.) is the property of SRS or its licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute or create derivative works without our express written permission.

8. User Conduct and Prohibited Uses
You agree that you will not use the Site in any unlawful or harmful way, including but not limited to:

  • Violating any applicable law or regulation.

  • Interfering with the Site’s operation or security.

  • Using false information or misrepresenting your identity.

  • Attempting to access any part of the Site you are not authorized to access.

9. Disclaimer of Warranties
The Site, our products and services are provided “as-is” and “as-available” without warranties of any kind (express or implied). To the fullest extent permitted by law, SRS disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, accuracy of information, and non-infringement.

10. Limitation of Liability
In no event will SRS (or its affiliates, directors, officers, employees, agents) be liable for any indirect, incidental, special, consequential or punitive damages arising out of or related to your order or use of the Site or products, even if advised of the possibility of such damages. Our maximum aggregate liability arising out of or relating to any order is limited to the amount you paid for the product(s) in question.

11. Indemnification
You agree to indemnify and hold harmless SRS and its affiliates, officers, directors, employees and agents from and against any claims, liabilities, damages, losses, costs or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or your use of the Site or products.

12. Modification of Terms
We may update or change these Terms at any time by posting the revised Terms on the Site. Your continued use of the Site or your placing of an order after such changes means you accept the revised Terms.

13. Governing Law & Dispute Resolution
These Terms and any dispute arising out of them or your use of the Site shall be governed by the laws of the State of Massachusetts (or the state where your company is based). If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

14. Entire Agreement
These Terms, along with any policies referenced or linked herein (e.g., Refund Policy, Privacy Policy, Bulk Orders Policy) constitute the entire agreement between you and SRS regarding use of the Site and purchase of products, and supersede any prior agreements or communications.
